Yes.
No, there is no legal requirement for change after devolution plus the Movement for Scottish Independence are proposing to retain the Monarchy. The change in the Union jack would cause changes in other flags around the world from Commonwealth countries to the state go Hawaii.
It is the national flag of the United Kingdom of Great Britain and Northern Ireland so it won't be appropriate when Scotland is no longer part of it.
W don't have a flag act like other countries HC so the ownership and jurisdiction of the flag is rather confused. To quote the chair of the All Party Parliamentary Group on Flags and Heraldry, Andrew Rosindale "There is no official legal protocol on flags, to the extent that you can't even say that the union jack is the flag of the United Kingdom."

Northern Ireland and Channel Islands are NOT COUNTRIES, Methyl.

"Movement for Scottish Independence are proposing to retain the Monarchy."

I asume from this they want to become a member of the Commonwealth. Whether they want to retain the monarch as their head of state (and so become a "Commonwealth Realm") is, like many aspects of Mr Salmond's half-baked scheme, not clear. Either way I trust they've run their plans past the existing 53 members of the Commonwealth and, of course, Her Maj. (I imagine she'll be keen otherwise she might encounter difficulties when trying to visit her timeshare home in Balmoral).
New Judge, I don't think Mr Salmond has ever checked any of his proposed memberships (EU, Nato, currency union, Scandinavian/Nordic union and now Commonwealth) with the groups he wants to join. it could be might lonely out there
Seems that the Mandarins in Whitehall are on the case, as below

Even by June 11th this still has "April Fool" written all over it. As does any article that contains the phrase "Whitehall mandarins" :-)
We'll just cross it out.
I don't think there's a patent on the Jolly Roger, you could always that.
^always use that
It won't matter, as they won't be going independent.

And there was me thinking it is the Union Flag!
bob561941 doesn't seem to know whether it is a flag or a jack.
