Caution for Property

My mum has her own house, bought and paid for by her and she recently married a few years ago. Her husband had sold his house and moved in with my mum. Unfortunately, my mum suffered a severe stroke 2 years ago and is now in hospital waiting to go into a nursing home. My brother (power of attorney) and myself may have to sell our mums house for her care but her husband has applied for a Caution on my mums property and told us he won't leave the house. Although, he can well afford to live somewhere else. He is blocking my mums needs for a care home. Where does my mum, me and my brother stand on this. My mum has now got dementia, too. Please help.

do you have to sell the house for her to go into care? it's quite unusual for SS to make you sell the house while a surviving partner still lives ther (it is after all his home too, even if he can afford to live elsewhere)
