My son got arrested xmas eve and has got to go magistrates on 10 Jan.
He will at least get court costs and maybe a fine. He is technichaly NFA (No fixed abode) but the custody sergant insisted that he gave an address for bail purposes and he gave mine. My concern is that he wont pay the court costs and that the next step will be bailiffs to recover costs.
Where do I stand in the event that bailiffs turn up at my address?
Ive seen tv programmes where they turn up because that's the address on the court order to recover debt and the people living there have to provide proof that the goods in the house are theirs and not the debtors. I have no receipts for anything as everything I own has been given to me or bought second hand.
Thanks for any advice guys.

Also, how would it work in court if he told them he was NFA?
Thanks

If he doesn't live with you make the Court aware of that fact.
You should have it termed C/o your home Nailit.

//If he doesn't live with you make the Court aware of that fact.//
My concern is that my address is now on his bail sheet, why should the court believe me if I say differently? They are going to want their money...
Contact the Court * insist he does not live at your address but collects his mail there, but they WILL WATCH your address.

TWR, he DOES spend time at mine as his mother kicked him out a few weeks ago and he spends time sofa surfing at various friends. But he is basically NFA.
Don't worry. They can't touch anything if he doesn't live there.
Question Author
WHO will watch my address exactly? Starting to get paranoid now as well, lol.
Question Author
Wouldn't be to sure about that ummm, seen plenty of programmes where bailiffs need proof that goods are yours and not the debtors...proof that I havnt got
Nailit....most people don't have proof of purchase. They won't clear your house. Don't worry.
You make the decision Nailit, if you value your household Items that you have worked hard to get, C/O Is the term I would use, he may be a friend, but friends can also be devious.

TWR its my son.
Friends / Sons, sorry Nailit but when Cornered they can all be devious, he may be your son but think about yourself.x
Nailit - he doesn't live with you. They can't do anything.

Have to take your word for it for now ummmm. Just seems a bit strange that the police wouldn't release him until he gave them an address. And how would the courts be guaranteed payment if he was basically untraceable?
Question Author
He recently lost his job and is not currently claiming any benefits.
What are the terms of his bail? It usually includes spending each night at the given bail address. People of no fixed abode are usually bailed to a bail hostel or similar so it's strange the sergeant insisted he give an address. Many people appear in court and state they are of NFA.

Have you spoken to the custody sergeant?
Question Author
hc, there are no conditions on his bail as it was only a minor offence (drunk and disorderly)
If your main concern is money owing to the court are you in a position to pay it?
It would stop you worrying.
Question Author
hc, not only am I in no position to pay my sons fines, I have no intention of doing so even if I could. Ive posted on here before about his getting himself arrested and not realising the consequences. Hes 20 now and has got to face up to reality.
