If you are over the limit, I hope you get your licence taken off you.

Have you been charged?  Was 41 the lower of the two Intoximeter readings?

The legal limit is 35 however some Police forces have a policy of not charging if the lower reading is between 35 and 40(in order to avoid any discrepancies or any dispute as to how close to the limit you were).

If you've been charged you will get a 12 month ban and a fine, but that's what you deserve, frankly!

Whatever you get just be thankful the police got you before you killed an innocent person.

I agree with what they said! you are so silly for doing it in the first place! I don't thik you should be allowed to drive EVER again! Fool
hopefully a big shock and a vow never to drink and drive again.
The book thrown at you hopefully! How would you feel if one of your relatives was injured or killed by a drink driver? You could have called for a Taxi & I bet you wish you had now!

What will you get?

Absolutely no sympathy from anyone on answerbank

you'll probably get at least a year ban and a fine. they work out the fine depending on your income. your driving ban may be reduced if you agree to go on an 'alcohol rehab' course which lasts about 16 hours over four weeks.

Not what you deserve, the laws on this are too soft

HEAR HEAR, Oneeyedvic!!  Jakaygem, you knew the risks when you decided to drink & drive, you deserve everything you get.

So, I take it that all of the people that aswered this have never drove after having a few drinks.  I find that hard to believe.  His blood alcohol level was not hugley above the legal limit.  Therefore, depending on Jakaygem's weight,  he may of had only 2 or 3 drinks at the pub.  I agree that he should not have done it and hopefuly he won't again, but he just asked a question.  He got 2 decent answers and a bunch of lectures from people, some of whom, I am sure have made the same mistake in their lives.

Actually, newtron, believe what you want, but i  can honestly say that i have NEVER EVER sat behind the wheel of a car after drinking alcohol, even if it has only been a very small amount.  So, although i most certainly am not pretending to be perfect,  i do feel in a position to comment on this matter.

Also, I realise that Jakaygem was only asking a question and perhaps didn't want peoples opinions, but, come on, what did he/she expect - praise?
I'm very proud of you kazy.  If everyone was like you, we would not have drunk driving problem.  Hopefully, there are more people like you out there than I thought.

A ban is obligitory, 12 months probably for your first offence, you may as said be able to get 25% shorter by agreeing to go on that course.

Obviously its not big or clever but everyone makes mistakes and im sure most of the posters have done it at one time themselves- im not saying all of them, at the end of the day lets just be glad nothing tragic happened - a lesson learned and all that.

Get yourself a good solicitor you should be entitled to legal aid regardless of your income.

PS. where you offered the opportunity to take a blood test ( 40-50 mg you have the right to that) if not, you should point this out to your solicitor.

For what its worth newtron, no of course I haven't driven after having had a few drinks.  If I'm driving I won't even have one alcoholic drink.  It doesn't matter whether his blood/alcohol level was hugely or marginally above the legal limit.  The legal limit is there for a reason & it isn't so the police can be spoilsports.  Personally I think the limit is too high but having witnessed my neighbour being turned into a virtual vegetable by someone who was driving a car while just over the legal limit, perhaps I'm a little biased.
It's easy- if you drink alcohol, be it even the tiniest amount (because we all know that your bloody alcohol level can differ depending on various circumstances- how much you've eaten, how much sleep you've had etc), DON'T DRIVE.

Whilst I agree that not all accidents are caused by drink drivers - the fact of the matter is jakagem was over the limit - end of story. It is proved that your driving is impaired whilst drinking. No I have never driven whilst under the influence. I am even paranoid about what time I should drive after a night out.

Everyone knows the rules about drink driving just as they know the rules on speeding. If you get caught you take the consequences. I know that if I get caught drink driving i will get a ban, just as I will if I get caught doing over 100 mph. No excuses, this will happen.

as to get legal aid - I really hope you don't and are not entitled to receive it. I certainly don't want to be paying for a solicitor to defend you, charging "the state" a fortune so that you may get off on a technicality even though you know you are guilty!
