Does it make any difference that Biden is still in office and Trump was not?
But where are the howls for impeachment and prosecution? Where are the searches of Bidens property, Jills underwear drawer and confiscation of passports?

Biden was a VP at the time shouldn't have had them. At least Trump was within the (what I think is a ridiculous) law and could de-classify at will.

Yes, he can control the FBI.

Personally I dont understand why anyone can take such documents home.

I think it has been proven in the past that the President thinks he controls the FBI but doesn't really.

It sounds like Biden legally had the documents, no one is accusing him of stealing them.
They are supposed to be carefully looked after while in the possession of the Vice President.
So he is just being accused of being a bit careless. When the error was noticed by the Biden team, the documents were returned to the national archive (who apparently hadn’t missed them).
There had been no requests for their return, no supeanas, search warrants or searches of the property.
Let us face it. The reality is that whether 'in office' or 'out of office', US presidents are immune from prosecution!

So whatever offences have been committed regarding the alleged mishandling of classified documents by Trump and Biden, the latter in my view, was by oversight.

The concern here is simply can it be proved that Trump's actions are so reprehensible that he'll be disbarred from running in the 2024 elections?

Don't hold your breath over the American court system applying appropriate sanctions even if Trump is guilty of destroying and/or mutilating official docs without the consent of the United States Archivist.

it seems he and his team have found them, notified the authorities and handed the records over.

I don't recollect that Trump was quite so eager to do the right thing.
