very difficult in practice - and the rules in english law are that if there is no defendant then the case doesnt go forward - recently over-ruled in a large part

in a work related disciplinary, the accuser declined to turn up coz he was so frightened etc and so the accusations lay on the table .... was the defendant worker required to disprove them - and if he didnt would be get fired ? God we had fun over that one.
