I think he may be found not guilty, because there may not be sufficient evidence to convict him of the charge, and unfortunately, having sex with a stranger without the courtesy of an introduction is not a criminal offence.

TTT - Were you not on here when the original (this is a re-trial) trial of Ched Evans took place?
There was a right old tear-up between those of us who thought that having sex with an unconscious woman was a revolting and illegal act, and those who thought that the girl asked for it by being too drunk to know what was happening.
Evans was convicted, but won an appeal, and thus a re-trial, we shall see what happens this time around.
