should i have received a summoms by now

the motoring offence was on january 8th 2008 but i have not received anything relating to the incident also policeman said he would call round to my house but has never done so is their a limit as to my being notified

For most traffic offences (those dealt with onloy in the mags court) there is a six month timne limit so yes, the prosecution time linit would be up.

What are the circumstances and what offence are you talking about -that will make it a bit easier to give you a better answer

my son s van was parked illegally (about 4ft)while we unloaded bricks ;the thing is i moved it there and i only have a provisional licence.a policeman came along and I told him that I had put it there .i had stupidly moved just a few feet I could have said my son had moved it.as nobody saw who parked it the policeman said i was very foolish and that he would probably visit after he had spoken to his inspector
Not quite. They have 6 months from the alledged (sp)offence tolay information to start the summons procedure. it may take say 2 weeks for you to actually receive the summons, so give it another week and you should be OK
A PC would not need to consult his inspector over this, it is simply to minor a problem.

It doesn't sound like the police officer has seen you drive and only has your word for it which presumably wasn't under caution. The only evidence would come from you from an interview which would form part of the summons file, which as above would be passed to the court to issue a summons.

I am pretty much certain that you will not hear anything about this ever again. For gtet about it and move on!

If per chance, a summons was raised this week - they would have to explain the delay to the court and it MAY be viewed as an abuse of process.
