faulty airbags in landrover

I was in a head-on collision with a tree in December last yr, had seat belt on, but got really hurt due to no airbags activating. My car was serviced regulary, and there was no warning airbags had malfuntioned, my car was 6 yrs old, i had for 5 yrs. It was a Landrover Discovery TD5. I hit the tree at approx 40mph, surley they should have worked, the car was a write off, and i was lucky to be alive. Is the manufacter at fault, and what are my chances for compensation? PS, is there anyone else outhere who has had the same problem with their landrover? Gloria

There are air bags in my car but the manufacter book does say the air bags should be replaced after 5 years
