Having been sentenced to "32 months" the most he will serve is 13 months. All prisoners serving determinate sentences are released at the halfway stage and those serving under four years are eligible for release under "Home Detention Curfew". A 32 month sentence qualifies for three months under HDC so he will be released in a ltlle over a year (less any time he has served on remand, of course). "32 months" you say to yourself. "That's almost three years". Except that it's just over one.

The judge will correct me here but he probably was banned for a year but as he'll be in the slammer for that time and the beak has no way of deferring a driving ban it probably did not get a mention.

Because these clowns usually love their cars the very worse sentence he could have had is to confiscate the car & crush it to scrap, that's when they realize the seriousness of their actions. The same with people who still drive whilst using a mobile 'phone.

Thanks Badric....4 year ban sounds better, although if he was "driving while disqualified" I am not sure it will make much difference !

Judges (and indeed magistrates) can impose bans of any duration up to Life, Mikey.

The sentencing guidelines rarely go much above three years but of course the sentence can go beyond the guidelines as this case demonstrates.

I assume he was convicted of Dangerous Driving and it looks like he got 20 months custody (maximum is 24). He will be required to sit an extended re-test before he is allowed to drive legally on his own again.

There is "Careless Driving" (where the standard of driving falls below that of a careful and comptent driver) and Dangerous Driving (where the standard of driving falls far below that of a careful and comptent driver). And that's it.
