Hello, if a divorced couple cannot agree how to share the profits of their home, that has been sold (she wants 70/30), he has agreed 60/40, can she take him to court and who would pay her costs, she is already on housing benefits.

Thanks

Housing benefit in itself is not an automatic qualifier for legal aid, but it is an indication low income and therefore legal aid to take this action is a possibility. If she was to get legal aid and won the case any legal fees would be recovered from what she has won. The only winners being the lawyers.

If she is not eligible for legal aid she will have to pay the costs herself. Difficult on a low income.
