My local council is paying compensation to school staff who claimed under Equal pay for long term underpayment. The payments vary between �100 and �7000 to staff. However, voluntary aided and foundation school staff are excluded can anyone advise why?
In VA and foundation schools the employers are the Governors and not the local authority. Although you may receive a payslip from the LA this doesnt mean you are employed by them because they may well have been contracted to provide payroll services.
Can we therfore take the Governors through any legal process so they can comply with Equal Pay compensation.
Can we take the Governors to a tribunal?
It appears that if you are employed in a voluntary aided (VA) school you are excluded from any entitlement to compensation is that not a form of discrimination ?
Surely the Law on Equal Pay applies for everyone to adhere to not just the Local Authority.
If the VA and Foundation schools used the same job evaluation scheme which was operated using the same pay line as community schools there could well be a case for there being one employer. This came out of the mouth of a Regional Employment Judge last week
