van insurance court summons

My boyfriend recently insured a van for 3 days to help my sister move house, he was on his way to the local tip when he was pulled over and asked to show his insurnace details when he shown the police his details they said it was void as he should have had business insurance the van got took off him and he had to pay �105 to get it back they gave it him back and that was that then today we get a court summons saying that he has to go to court for having no insurance - but he did just not business insurance but he was not running a business with the van just helping my sister out,
can anyone tell me if u can fight this and if we do will he get punished even more for pleading guilty??
if he does plead guilty wot is likely to happen he already has 6 points an we cant afford for him to loose his licence as he would loose his job???
