Who has the legal right to erect an headstone on a grave. i am the legal owner of the grave plot but one of my brothers is the executer and he his saying that only he can do this?

Since u are the legal owner of the site only u can have the stone erected.....or put another way, u tell the caretakers of the cemetary not to allow a stone on ur site without your consent.

If it is erected on your site (ur property) you can instruct the caretaker to remove it and send the bill to who-ever erected it; and if unknown to the caretaker then the caretaker was negligent!
