I have legal right of way and access to the rear of my property for over 27 yrs I have maintained the land to the rear of my property as well cleared weeds rubbish and now drug needles and such. because of the way the land lies i have severe flooding to my property on a regular basis. the land is unregistered and does not belong to the council. do i have a right to claim it ,fence it off so that i can level it out to stop the flooding

There is a law where you can fence off and claim unregistered land. I'm not 100% sure of the timescale but I think it may be 7 years.
You could ask a solicitor just to be on the safe side. A first 30 minute consultation is free.

You could alternatively locate the owner of the unregistered land to purchase it or at least discuss the option to level it off. There are a number of companies that do it but i would recommend contacting the company before you order. Search for "Unregistered Land Specialists" in any search engine.
This would be ideal case for submitting a land claim to the Land Registry via http://www.claimfreeland.co.uk.... You have obviously had access and use of this land for some time and that makes for a great claim........
