council tenant

my partner and I had a joint tenancy she left me a year ago, we aplied for the tenancy to be put in my name but they refused now she has been gone over a year does anyone know if I have an automatic right to the tenantcy or where in fact I stand at all, because the way things stand now she could just move back in.

i think after a year thats when u can apply to ur council to have her name taken off the tenency seen as she isnt living there ne more......and if you can prove she isnt living you then im sure they cant refuse but if in doubt go to cab for advice there pretty good

I am sorry,but the tenancy will go on as in two names until you move out.
A friend was in just this situation last year,and this is what the council told him;that they were unable(under the law) to "vary" the tenancy.

How long has that been law then? I had my ex taken off the tenancy but it was 17 years ago now. What happens if a joint tenant dies? Joint tenants are jointly responsible for the rent. So, in effect, if you didn't pay, they could go after her!

I know for a fact this can be done .I got my ex to write a letter to the council giving up his rights to the property.As soon as the council received this I had a letter back stating my name was on property only . Hope this helps.
