my elder brother has spent money from my dead brothers estate without knowledge of the rest of the family what can we do about this

You really need a solicitor for this now, before any (more)harm is done.A solicitor will get the key facts that he or she needs to know and advise properly.
Was your elder brother the Executor of your deceased brother?
If so, he will be responsible for ensuring that the assets from any Will your brother has made are distributed according to his wishes and he can be sued if he does not perform this task properly. If your deceased brother did not make a Will his estate will be distributed according to the laws of intestacy, and an appropriate relative will have to apply for Letters of Administration, and the deceased's estate should be distributed according to those rules. If you have reason to believe that a family member is not acting properly you need to take your concerns to a solicitor.
