My girlfriend and I have lived in a flat for four years, we have not signed or renewed a formal contract with the estate agent last year or this year (it should be signed in Oct). We have found a house to move into and the estate agent has been extremely rude and insisited that we give two months notice on the property and has almost dared us to get a solicitor involved knowing full well we can't afford it. She says that the contract carries over wether we sign it or not it just re validates itself. Can someone who knows about this stuff please advise. I personally think she is just being a little jumped up. help!!!!!

Legally you need only give one months notice but I would need to check whether this should end on a rent day or not, havent got that info to hand, sorry.

Once the AST expires and you stay on in the property your tenancy become a Periodic Tenancy with the same terms as the 6 month contract apart from the landlord having to give you 2 months notice to vacate and you having to give 1 months notice.

So, yes, you would need to give notice of at least 1 month. You could have, however, moved out of the property without any notice at the end of your AST in October.
Basically the tenancy has gone periodically, this means you have to give one months notice and it must end on your rent date for example. Say your rent date is on the 16th you would have to give written notice on or before the 16th to leave on te 15th of the following month. 2 Months is b o l l o c k s. I work in a letting agent and this is the law.

You could just give notice and leave and say take the last months rent out of my deposit, they may say no but really there isnt anything they can do about it.
