when the manager became pregnant i was promoted to take her place for the six months maternity leave . the agreement was that if she came back five days a week i would stand down but if she came back part time i would remain manager.

she came back last week for three days a week as manager and we were to share the job between us. she had wanted to come back as a buyer five days a week but the boss refused because he wanted her as manager.

do i have a case for constructive dismissal because he broke the agreement we had?

Surely you would only be manager for the days she wasn't working. Your company must give her her old job back . Do you expect them to employ 2 managers? Do you have this agreement in writing? What was the wording on your maternity leave contract? Case not clear enough for constructive dismissal yet.
