where do I stand

We are seperated but husband pays mortgage. He was coming and going as he pleases but things changed and I asked him to come only when I was at home. The only time I don't want him there is 8-30 till mid-day. He says as he is paying mortgage, he should be able to come in anytime he wants. My solicitor says I am not being unreasonable but he is going to see a solicitor on Monday and says he will file for Divorce. Am I within my rights to state I don't want him there when I am out. Anyone know

The normal rule is that, if you are joint owners of the property, he has as much right as you to be there - he could even insist on living there. The exception is if you have a Court order barring him from the home. Your solicitor is the best person to advise you on your particular circumstances, but I am not aware of anything that would chnage the above. (Whether what he is wanting to do is reasonable in the circumstances is another matter.)
