Not sure if this is the right place to ask, but basically i am currently going through a residency battle with my ex husband. Only two weeks ago, telephone contact was re-instated after a 10 month gap. Although now he has stopped telephone contact again. The question im wanting advice on, is what would happen if my ex doesnt attend the final court hearing? He has also moved without telling me (although i know the area to which he has moved). Any help/advice would be appreciated. Thanx.

god, talk about coincidence - we are in exactly the same boat - my b/f's ex has moved without telling him for the 3rd time! She has been served papers to attend court & disclose address, but as far as I am aware,if she doesn't attend then she is in pretty serious trouble.
Well i would think that if he doesn't attend court then that would show he is not committed and therefor there would be no question over residency. Why was he applying anyway??? It sounds to me like he is playing games with you a bit like my ex, i shouldn't worry about it to much (but it's only natural to i know) good luck
Do your children live with you at the moment? I just wondrered,as you said there was no telephone contact,so I thought maybe they are with him and he's stopping you seeing them.

Thanx for the replys. It is my husband who has the children at the moment, but due to him not looking after the children i have applied for residency. He has constantly tried to stop me having contact and due to his new partner hitting my youngest which has led me to apply for the residency. The prob i had was i live approx 200 miles away so basic contact has been difficult. He actually rang me last night to give me his new address which was a turn up for the books ! I am just hoping that he turns up i court for the final hearing.

Thanx again thou, to you who replyed.
