In the case of receiving a damaged and unfit for purpose vehicle is the consumer entitled to a replacement vehicle courtesy of the car dealership?

In theory, yes, but in practise very difficult to achieve. Firstly once they have repaired even the tiniest fault you are deemed to have accepted the vehicle and then it's a up hill struggle. It's a sort of industry mantra, they never change a car or refund the money, they'll try and fix it. The problem is, that unlike the US, we do not have Lemon laws.
