Criminal

Charged with Common Assault on my Partner

Can anybody give me some advice i have been charged with common assault on my partner and am due to appear in court soon. My partner is going to withdraw his statement as he was drunk and does not remember what he said in his statement and also as he is not an english speaker didi not fully understand what was going on. He is gong to tell the CPS the same and also if forced to appear in court will also say the same as he wishes to continue the relationship. I will be pleading not guilty as it was just an arguement and i did not assault him. What are the prospects of the case being taken any further and if it is what is tha chances of being found guilty and finally what can i expect to happen to me, could i go to prison for this?

Is there any other evidence against you apart from your partner's statement?

Then the CPS is unlikely to proceed as they will have some difficulty proving that you commiited an assault.

I really dont want it to have to go to trial when i plead not guilty and make him look stupid in court he was drunk when the statement was taken and was not given the option of a translator as he is polish and does not have all the best of english. I just want it sorted as its going to be a total waste of taxpayers money.

What a nice life you lead. Too drunk to remember, police called, such a pillar of the community.

Hi Chris, please ignore the comments of ignorant people who have nothing better to do than post racist unhelpful comments, whatever the rights and wrongs of this case you do not deserve those comments.
Revfunk you have been more helpful in your comments but unfortunately you are wrong about nice people not being assaulted, my partner was attacked without provocation, he had a chair smashed on his head, his attacker went to jail for 3 years.
I cannot answer your question sorry, but hope that New Judge has provided the right answer for you, common sense says that this is what wil probably happen. I just wanted to let you know of my disgust at the answers given to you.
Cheers Sue

Sorry Chris I meant to put homophobic in my last answer but for some reason called it racist, showing my ignorance there perhaps!!!
