I'm not sure if I'm really convinced by her case, that she "genuinely believed" she was a male. Or at least, not as a defence. Even if you are a transgender there comes a point in a relationship with someone that you're going to have to tell the other person that. Still, the judge was convinced and I've only got 3 lines from a Daily Mail article to go on, so maybe I have missed something.

If it is deliberate deception or for sexual gratification then definitely. the same goes for using toilets or whatever, otherwise how do you stop the perverts?

Alternative is for the lasses to ask us to get our tackle out first date; just to check early on !

May be an idea if the arrangement is reciprocal.

As others say it is the intent to deceive that is the crux of it. In some circumstances hiding your gender isn't an issue; trying to get individuals to be attracted to the gender they have no wish to be intimate with, sounds a good example of where it is an clear issue. In any case a transgender person who is entering a relationship with someone has a moral duty to advise the potential partner that they are mimicking the gender they were not born. Many would be very uncomfortable, to say the least, at such a situation, and have a right to know; not to be deceived.
