I have been accused of theft from my employer, something I completely deny. I have not been charged however, I can see this happening due to circumstantial evidence. I look forward to my day in court. It has become apparent the police are missing the issues that can prove my innocence all be it I concede it is their job to help prove my guilt. They have not searched my work place fully or even close so realistically I have it in my mind that they can't say for sure things are missing. My 1st Q to them in court would be, have you searched, answer not fully. Then how do you know they are missing. Am I barking up the wrong tree here. The implication of being found guilty is huge, I will lose everything including children, home, wife, job, pension etc. Grateful for any help/guidence.

As I have said the company has not followed the correct procedure here at all , they should never have accused anyone of theft without a full physical check and stock take . I am certain that the company can not now proced with the accusation, they have already made such serious errors that the case could never go to court. I would definately now sue your company...

why would it be the role of the police to 'search' your workplace? If it is goods missing, the only way to identify if anything is missing would be to do an audit, the cops wouldn't be able to do that would they? I don't know why we aren't being told just what idon has been 'accused' of thieving from their employer,
Could it be that you think you have been accused of theft? Perhaps you need to talk things over with your doctor?
how long have you worked for the company? they should have regular appraisals? proof you are a good employee...

Thank you to all for your replies. I have certainly not been suspended. It is the police who are persuing this, my employer has given witness statements. I am the only one that is accused. An audit has been completed however, a physical check has not. There is a reliance to believe the computer without checking. I would have thought the police would want to be robust in their investigation. As someone with a previous unblemished track record and outstanding appraisals I find the whole situation baffling but my god, stressfull beyond belief. I have discussed this with the solicitor but he is not too interested at the moment as I have not been charged. I am just trying to get any help/advice just in case the CPS decide to pursue this.

I've looked through this thread a few times and I don't think we've established yet what is supposed to have been stolen.
Do you think you know where the item is? You seem confident they will find it if they look for it
Are you in an appropriate trades sunion? If not, join today and get an experienced union representative on the case.

From what you have said, there seems to be no evidence against you - but your rep will have full understanding of appropriate proeceedures to be followed, and laws to be obeyed, so get them on to it now.

Update: thanks to all who have replied. Was due to answer bail soon and have been notified they want to question me again on arrival. It makes me think they are fishing as they still don't have enough to go on. I think, how could they since I did not do anything wrong. My solicitor has suggested that after this questioning if no new questions,answers need investigating then the case will go to the CPS. Anyone know how long this will take? This whole thing is torture.

The case will probably be dropped if the CPS don't feel the evidence is strong.
I still have no idea what this case is about- what is alleged to have been stolen, what the circumstantial evidence is, why they think it has been stolen if they haven't looked for it at work, etc. I also don't understand why the police are pursuing this if your employer seems quite happy not to suspend you- did the employer bring in the police?

Thanks for the reply. I am still NOT suspended. I think my employer worked with the police to start the investigation, unsure as not privilaged to the info. The circumstantial evidence is that they have not established that items have been stolen, they are believing some data on a computer however, have not physically checked.
I am pulling out of this one as I never seem to get any more information whatever questions I ask.

Hi, do you have any specific questions?
Reading your initial post, you say you have been accused of theft and that you deny it, but you have not said clearly what you are supposed to have stolen and did you do it? You look as if you are not being very helpful in this, e.g "they have not searched my workplace fully or even close" so do you actually know where the stolen items are - you sound as if you do, if so and you didn't steal them why not say? You sound as if you are playing a kind of "gotcha" game hoping they get it wrong . Who has actually accused you of theft - is it your employer? If so, I would have expected them to at least suspend you pending investigation. Basically, it seems to me there is a lot you are not saying about this!
Have you now been charged by the police for theft? Asking because you mentioned responding to bail earlier on in one of your replies.

58 posts later and we still have no more idea of what this is about and therefore how we can help.
If people want legal advice they need to give us a proper story so we can advise properly.
The whole story seems baffling to me and doesn't hold water.
Sorry but I think this is pure fiction, did you borrow a book from your public library & decide to use the plot on here? If what you are saying is true tell the facts, put up or shut up.
