i'm wondering if anyone can help, my boyfriend is up in crown court next month for 2 account of ABH with his 2 friends. they are all first time offenders and hold down good jobs. the 2 men they were fighting with are 10 years older. what is the likely hood they will receive prison sentences??
Did he plead guilty or not guilty? If he entered a not guilty plea did the magistrates decline jurisdiction (because they considered the matter too serious for them to deal with) or did he elect for a trial in the Crown Court?
One cannot plead guilty and then elect to go to Crown Court. That option is only available in the event of a Not Guilty plea and where the Magistrates have decided to accept jurisdiction..
If he pleaded guilty it is solely a matter for the Magistrates to decide whether to sentence him theirselves or to send him to the Crown Court for sentence if they consider their sentencing powers are insufficient.
Please find out what really happened as this has a considerable bearing on the likely outcome.
I'll be honest with ya a family member went to crown court 2 years ago on an abh charge (glassing someone) and was given an 18month sentence but served only 5months and 4months on tag.
