A livery yard that i use for my horses has got a problem with one of the people that brought a horse to stable there.he has had his horse ther for nearly 3 months now and will not pay for the cost of the horse being there.he does not come to the yard or look after his horse.he wont give his real name or address ,he only contacts them by text saying he is comeing but never does.We have found out he ows money all over the place and is known as a story teller,he is known to the police but they dont seem to want to do anything. He now owes 400 in back livery rent.We are looking after the horse to a good standard but this cant go on.we feed it and see to its needs but it needs its hooves seeing to but we cant do it because he wont pay and also wont give permission to get a farrier even if we pay.Can the livery yard owners take possetion of the horse to cover costs and ensure its wellbeing.

You could take possession of the horse to cover costs but only if you take him to court first (otherwise its theft even though he owes you money).

It might be an idea though to inform the RSPCA as they do have the permission to take possession of any animal to ensure its wellbeing. This process would be much quicker than going to the courts and less costly. And if you explain the situation to them I would be surprised if they didn't then give the horse back to you.
