child support after job loss

My husband pays $2000.00 a month in child support to his ex wife that was deducted from his paycheck each pay period. He just recently lost his job that he had for 13 years. He filed for unemployment and filed to modify his child support until he finds another job. His ex's attorney wants to postpone the court date for two months because she wouldn't be available on August 10th to go to court, her attorney has also asked for my husband to answer discovery on why he lost his job (because his ex heard that he was forced to quit) AND they are asking for my income information! Can they use my income to calculate child support when they are not my children? Why would they ask for discovery on why he lost his job when he is receiving unemployment ?

Your income is only relevant in so much as you share living expenses although if you receive Working Families Tax Credits on behalf of the family it would be included as part your husband's income for calculating child support if he earns more than you.

If your income is higher than your husband income, it will be considered as the family income and you may be charged for the child support. In United States law, according to Bradley amendment you cannot reduce or get rid of the child support just because you lost the job or your income has reduced. Although you can take case to the court, sometime your stated change of circumstances can work. You may need a family law attorney who is well versed with the child support cases.
