Bressumer Beam Repair

I have been told that the flat that I own requires a repair to the bressumer beam which supports the bay window. I have been told by two surveyors that this is normally a repair that is paid for by all the owners in the building as it is part of the fabric of the building. The property factors have said that it has to be paid for between myself and the neighbour below.
I have looked at the title deeds and although it mentions all the other parts of the building i.e. the roof, roof trusses, walls etc as being common repairs, it does not specifically say beams.
Would this be understood to mean all of the building that would affect other flats or would it specifically have to say beams in the title deeds in order for it to be a common repair?

Look at the terms of your lease, Curiosa. It may be different, but usually the fabric of the building is maintained by the freeholder. Structural beams are part of that fabric.

Do you pay a maintenance charge to a Management Company (which is often the freeholder as well), or do you and the others own the Freehold?

Sorry, I should have said this is Scotland. All properties are freehold. I know that in other tenements in Scotland that this kind of repair has been shared by all the joint owners of the building, but I'm not sure if their title deeds have specifically stated that beams are included in the communal burdens.

So your complex is of many flats, this structural beam sits holding the roof up, over the bay window shared between just the two of you only, and the factor is saying it isn't part of the building fabric? Sounds implausible to me, but I'm no expert in Scottish law. Which is why I didn't reply earlier. This doesn't have such specialists.
You could try getting one of the surveyors to negotiate the point with the factor.

PS If your other question about switching question categories relates to this question, there is no real need as members look in multiple categories. Sometimes it is a pity they do as people with no actual knowledge trot out the same simplistic answers.
