Failed to get a place at his chosen college-appeal?

One of my friends son has failed to get a place at his chosen college.He is on special needs due to mild autism and his school sent his application late.
The college were made aware of the scholl's error in a phone call (after the reject letter)- but said it would depend on other students dropping out.
They did spefically also state that no student such special needs was prioritized -it was strictly first come first served
Is there any appeal process? - as i don;t think the college have considered the individual merits of this application

if there is an appeal process the college would know about it
How come the parents couldn't fill the form in and send it away, on time?
Might have something to do with the school having to confirm the special needs status.
Children with special need do need extra attention and sometimes 'special' care. Perhaps the class is full and there's no more room to accommodate your child.
Society, a school or college is not allowed to refuse to enrol a child/young adult at their establishment based on their SSEN status, that would be against the law.

There should be no bending of the rules or prioritising because of the boys autism either. I would appeal if I were the mother of the boy, but would appeal for any child not just the one with a statement of special educational needs.

P.S. I have a son with Asperger Syndrome so I do have a very good idea how they system works.
also, if the school had to sign the forms, did it mean that it happened to other people? That would change things, if there were several people in the same situation.
