Dont be scared... when i went there were 3 people sat at a big desk.. i had to stand in what id call a" witness stand" a bit like a court one... a lady / man will be there to look after you, just tell the truth, try and keep calm ( dont shout or loose your rag) lol, youl be asked a few questions regarding your claim -good luck

I have to make my mind up take a payout which im not happy with or carry on with the Tribunal. What i needed to no is what it was like in court. You have answered the same as i have just found out of a family friend. You have put my mind at ease Many thanks |

Both my friend and i walked out of our jobs as i classed it as "constructive dismissal" she said a few times "you know where the door is if you dont like it " plus loads of other stuff and to long to go on about it on here ...! horrible bint she was!! I took her to a tribunal and won : ) -- hold out there -i bet youl get more than they offer you " out of court "

Mine is "constructive dismissal" i do have a good case.

You will need to place file your grivence within 3 months of being dismissed. If your old employer knows this they may keep dangling carrots hoping you will not realise and miss the deadline.
I took my old employer to tribunal and they are very wise people it is very hard for employers to pull the wool over there eyes, as they do this every day. My ex employer hired a barrister (to stop others from claiming and scar me in to no progressing) and just by teling the fact as they were I won. I was not told until after the case had finished that it was the first tribunal my solicitor had done! We still won. Make sure you ask lots of questions from your solicitor first and that they have knowledge of tribunals first, they will in my experience take any case. They are wise people if you are right you should win. It's a lot of anguish but it's a great feeling when you win. My case was better than my spelling |

It is informal The fella at the top calls the shots and he let the employer go first ! and then he said - can you present your evidence in chief ? and I said no, so they took me through it Questions were asked by the employer and then they went out for 30 mins He then began...... There is no question PP could have asked, there is no statement he could have made, there is no document he could have presnented Oh whoops, that is called a 'bouquet' and means you have lost...... he continued presented that could have persuaded us.... Then he gave me a tutorial on the recent EMployment act 1996 and basically you can only win on procedure that is, that the Emplyer did not follow his own disciplinary procedures......(because an employer MUST) you cant win on anuything else because there is no requriemt that your employer be reasonab;le. good luck ! |

Sometimes the employer will back down if they think they are going to get bad publicity and settle out of court .It's a gamble you take .I was made redundant ..several years ago now ..because the company were having a "makeover " ...they then advertiised my job as " no experience neccessary " and I had been in the job fifteen years in a senior position. So I took my complaints to ACAS.
I spent a nerve racking eighteen months until my ex employer jacked the money up to what I thought was acceptable and I settled out of court ....but they only stumped up the day before the hearing ! It was a game of cat and mouse really. Had it gone to the tribunal I had all my paperwork ready and representation,character references etc. Make sure you do too..Whatever happens ....good luck ! |
