Self Employed?

I set up a business with my dad as a partner back in 2001. I left the business to train as a teacher and have since been employed. At the moment I am not working as a teacher, but Im signed up to employment agencies. (Had a few nibbles, nothing bitten)

I was always good at the sales side of the business and, since dad has no time to do this, I have (instead of signing on) been providing sales services by way of consultancy...giving him invoices, organising my own time and duties.

It is my intention to declare these earnings at self assessment or by some other means. I haven't set up my NI contributions yet but, assuming I do these two things, am I legal?

I have tried getting advice from HMRC but don't seem to fit into a department.

Any advice would be greatly appreciated. Although I know the agencies might ring with a new job tomorrow...

You must discuss your situation with your accountant. This is a complete minefield and the inland revenue can just shift the goal posts as suits them.

Please, please take this to your accountant. I have been on the recieving end of an IR investigation when I was employed and doing freelance at the same time. They will tie you up in knots, never give you the same answer twice and eventually you will have nothing but hassle for years to come.

Do yourself a favour and put your finance in order now!
