Daughter asked to leave

Help ... my daughter has been working as a recruitment consultant for about six months but they had not given her a written contract ... she decided to leave and responsibly gave one month's notice yesterday however they have told her to go today and she is quite shocked. Can they do that, do they have to give her any money in lieu ???

If a contract of employment does not provide any notice terms, then employment legislation states that where an employee has been employed for more than one month but less than two years, then either party must give the other one week's notice. (I'm assuming your daughter was an employee (e.g. not a contractor), was not on a fixed term contract which has just expired and was not summarily dismissed for reasons of conduct etc?) Your daughter should tell her employer she is entitled to one week's notice (or, of course, she can accept payment in lieu of notice).

Miss Z is right as far as notice periods go but this should be in her contract because it can vary.


The other reason they may have asked her to leave and its not to the detriment of your daughter, is to protect information she may be able to take with her especially if she was leaving to go to a rival. Its quite common practice and nothing to be shocked at.

There may also be some wording to say " these are the notice periods but they may be waived by the aggeement of both parties"
exact same thing happened to me and they had to put me on gardening leave.
