My boyfriend was involved in a car crash today, we were coming out of a junction and indicating right onto the main road? We came out and a car on the carriageway crashed into us. Our car has severe damage to the right hand drivers side and it's likely to be written off. Under normal circumstances, I think we would be to blame because we were exiting the junction. However, we feel the other driver may have been speeding. How do we not accept liability in this situation? Are the insurance company likely to look at the impact on our car and work out what speed she was travelling at? Or do you think we should just accept our losses and realise that we are going to have to accept liability? Please help!!!

Your fault, no way out of it unless you have independent witness who will swear in court that the other car was exceeding the speed limit.
Short answer;- At the end of the day, your boyfriend pulled out from a side street onto a main carriageway, and will be to blame, It is annoying and upsetting when you have an accident and many thinds go through your head, personally I would just count my self lucky that nobody was seriously hurt ( I am sure this is the case, reading between the lines of you question ) learn from the mistake and accept liability, It happens to all of usat sometime.
Same thing happened to me about 5 years ago.

Restricted vision due to stopped traffic I edged out and bang.

She was speeding, late for getting her son to school aparently.

No difference, my fault.

If you fight it you're almost certain to lose and you'll give yourself a load of grief and worry.

Just accept that the dice rolled against you and move on, you'll save yourself a ton on mental anguish.
Hi all, I have noticed a lot of question / advise regards what you say Lucylocket the way I would go about this although it may now be too late in your case!! I would take a photo from all angles of the obstruction and present your insurance comp with the evidence, I think too may people except that they are at fault in this instance but hold on here, if you cannot see left or Right because of parked cars surely someone has contributed to the accident, how close was the car parked to the junction ( The one that you came out of? If I have my facts right the car parked near the junction should be 25FT, I would check this out.
