Unregisterd points

I was recently involved in a collision. My car has been written-off by the insurance as a Cat D. We have been made aware of the cash in lieu figure and the payment figure which we are going to dispute.. we have received all the forms etc today and there is a driving license mandate atttched.. my query is that my husband who is the policy holder has had points on his license which were up in sept 07.. the preminum ran march 07 - march 08. can the insurance be invalidated???

By "up" I assume you mean they were three years old six months after the policy began (so two and a half years old when the policy was taken out).

Most insurers ask for convictions going back at least three years to be declared (and any obtained after the policy began to be declared as well). . If they did and your husband made a false declaration, the policy will almost certainly be invalidated.

This probably means no payout (which will save you the trouble of disputing the amount) and possible prosecution for driving with No Insurance if the police become involved.

I assume that as it's only 3 points, it's probably just an SP30.

if that's the case, then so long as you don't have previous claims or convictions that are disclosed, it's unlikely to make a massive amount of difference (if any).

We don't take that much notice of a single convictions such as this (it's not to say you shouldn't disclose it as each case is taken on it's own merits), but if it's anything other than a speeding conviction, there could be an increase in premium.

Generally, the only single convictions that make that much a difference, and could potentially result i nyour policy being voided from inception are:
No insurance, drink or drugs related, driving whilst banned, and failing to provide the driver's details (MS90).

They are all generally automatic voids.

Most insurers will also ask for convictions within the last 5 years, and claims within the last 3 years. The licence mandate (which we always use and have a very good detection rate of undisclsoed convictions off) will show all your convictions over the last 5 years, so I hope that's the only one.

yes it is the only one it was a speeding ticket and it wasnt disclosued to the insurance.. it wasnt until we made the claim that we realised he still had points... (stupid i know).
neither of us have any other convictions....
will the driver declaration that came with the claim pack show all previous convictions or do they just need to see the paper part of the driving license.. it is quite a big payout

The licence mandate allows the DVLA to relaease the full licence records they hold. This includes changes of address, changes of names, and a document history which is what your insurer will be looking at.

This is a list of numbers that represent dates/events with descriptions of what they mean.

Any convictions you had would be listed as ''court notification'', even if it's just a speeding ticket (and no court appearance). This list will go back to the date the licence was issued.

Normal convictions (fixed penalty convictions that is) should be visilbe in full for up to 5 years. Anything else (apart from drink/drugs) will not show, although as mentioned, there may be mention of a court notification - if it's over 5 years ago, they won;t be that interested.

We rarely ask for copies of the licence as so many people get duplicates to get their points added (so they have a clean licence to produce to us)

Can we just send copies of our driving license then? Or do we need to send this mandate aswell?
