What to do about noisy boiler flue?

My upstairs neighbour has an oil boiler flue (new), above my bedroom window, which operates the fan at regular intervals day and night, making it impossible to sleep. Are there any possible solutions - silencers etc? Are there regulations about noise?

Does it sound as if everything is working correctly? A fan should not make that much noise. Have you spoken to neighbour about it?
