Is there a minimum distance for the height of the patio from the damp course?

Two bricks is regarded as the minimum. This allows for splashing onto the patio without the water rising up over the damp course. In dry areas, I have sometimes reduced it to 1.5 bricks when it is unavoidable, without trouble.
