Disputing A Private Parking Notice
59 Answers
Has anyone had any luck disputing a parking fine when they know they are in the right? I`ve got one this morning and am going to dispute it but as the parking company want to make their money, it`s their word against mine. Do they ever back down and say "OK then, we believe you and you don`t have to pay".

In fact in my experience they send out a few letters and if you completely ignore them they give up -too expensive to take to court and it does not effect your credit rating (my experience only). IF you start negotiations with them they will never back down.
It`s from the local hospital. I`m up there just about every week for my Mum`s ongoing health problems. She has a disabled badge which we always, without fail, display on the front dashboard. Blue badge holders are exempt from payment, regardless of whether they are in a disabled bay or not. I never, ever fail to display it and I have never got back into the car having found that it`s fallen from the dashboard. Obviously some parking person has gone around the car park and missed the sticker. There are two pictures of my car - entering and leaving the carpark.
Apparently if it's a "Parking" Charge Notice, you don't have to pay but if it's a "Penalty" Charge Notice then you do. Only the Council and the Police can fine you for parking where you shouldn't and they do this with Penalty Charge Notices. The private companies who pay others to send out the parking charge notices can't do anything about it, although they might send you lots of letters threatening to take you to court. That's what I heard anyway....
Thanks for the link Balcric. Misky - yes, it`s a Parking Charge Notice. I guess I will photocopy my Mum`s appointment card (although I don`t see why I should disclose her medical details to these people so I resent having to do that a bit) and the disabled badge and send it off. I don`t mind coughing up £50 if I`m in the wrong but I`m not so I`m going to fight it. I`ll threaten the F*****s with court action if I have to.
Was your mother with you to visit the hospital for treatment or where you visiting her as an in-patient at the hospital.? If the former I would do no other than send a copy of the valid blue badge to the parking company and tell them politely it was displayed and their parking operative had overlooked it. Their mistake. No payment and no further negotiation. If she was not in the vehicle and you were displaying her blue badge you may have a problem with regard to fraudulent use of the badge.Hope that wasn't the case.
The trouble is, if I don`t contact them they will keep pestering me and I just don`t need the grief at the moment. The charge also doubles to £100 if I don`t pay within a certain time. I`m up at the hospital so often that it all blurs into one but I can remember the morning. I left my Mum there for a blood transfusion and went back later to pick her up. The funny thing is, in the photo of my car driving into the car park, you can see (but not clearly) the disabled badge on the dashboard.
You don't owe anything.
They have issued you with an invoice for parking in a car-park which they supervise. You have already said that you are convinced that they are in error.....let them prove that they are in the right. Photos of you entering and leaving prove absolutely nothing.
I certainly wouldn't be coughing up £50 for no good reason....

It would cost the parking company a fortune to process this parking charge and take it to a civil court. It is not worth the trouble. Even if the photo displays a blue blur in the windscreen I would be happy to attend a civil court with my mothers blue badge as additional evidence and ask for costs against the parking company. Your evidence seems to me more compelling than theirs. They would be the losers in the end and it isn't worthwhile them pursuing it.
