Did you father leave a will? In which case things are distributed as per his wishes. If he did not leave one then the laws of intestacy take over. You would need to see a solicitor about his estate in either case.
question 1 of hundreds ... did he leave a will?
1. As others have said did he leave a Will
2. Who, precisely, owned the property "It was owned by my family". So who actually owned it.
Question Author
there was no will
1. Which country did your father live in?
2.do you have any brothers and sisters?
3. was your father married at the time of his death

maybe 3 is more important than 2 but not as important as the previous questions above mine,

my father owned the house

he wasnt married but left behind four children.he lived in lancashire england
oh i live in lancashire, there is a probate registry office in manchester, and a sub-registry in lancaster (or there was).
The info you have given sounds straightforward. You need to apply to the Probate Office for Letters of Aministration, then your fathers esate, after any debts and bills are paid, will be divided equally between his 4 children.

the problem i have is that the council condemned the house as unfit to live in and applied for a compulsory order to buy the house from from the estate.can we his children stop this going through and sell it privately
You can object to the CPO but I doubt you'd succeed. I can't imagine you'd finder a buyer- the CPO would be picked up by the buyer or their solicitor.
The administrator of his estate can take the same steps he could have in his lifetime, and the sooner the 4 of you get together and agree on who should be appointed to that post the better.

Type Your Answer Here...i am second eldest and i am the executor to the estate as my eldest brother isnt fit to be
Question Author
thanx for all your advise guys.really appreciate it.
I hate to burst your bubble, but you are NOT the executor.
You can apply to become administrator (obtain Letters of Admin), but the court would want to know who else has an interst in the estate, and you'd do well to seek consent of all parties first.
i thought that flyhalf, if there is no will there cannot be an executor as none have been named in a will or appointed by the probate registry.
Did the house get the CPO before or after your father died and how far along is the order? The settlement must have involved a solicitor surely and the sum stated in the CPO will be part of the estate for probate as well.
You are right flyhalf. If there is no Will (and presumably no spouse) any one of the children can apply for a grant of Letters of Administration. It is not necessary to notify the other siblings.

It depends on what stage the CPO has reached as to whether the administrator can do anything.

And NO, Michael, you do not have a right to the house. It should be sold and the proceeds split 4 ways.

i was contacted by estate researches and asked me if id liked to be appointed as the executor.i said yes and they then appointed a solicitor
Question Author
ok thanx.thats was the info i was looking for thanks again
you've been contacted via these people probably because your father's details were on the Bona Vacantia List, they'll take a cut you know,
