I am currently on maternity leave and my SMP stops in the middle of Aug. However, I want to go back to work at the beginning of Aug but not to my current employers. Can I hand my notice in even though I am still on maternity leave? I know I can't work while on maternity.

Yes you can and in fairness to your current employer the earlier you tell them the earlier they will be able to find a replacement. I was told by an employee that she would not be returning from maternity leave on the Friday before she was due back on the Monday. This meant I had to then start recruiting and training someone new. I was not happy.

Thanks. They've got someone to replace me as I told them from the start that I wouldn't want to come back full time and because my role can't be done part time I said I wouldn't mind doing something else. Obviously this wasn't set in stone but I think she's got an idea that I won't be coming back!
