My frind has a court order in place. The childrens father has access every wednesday and every other weekend. Friend is a teachers assistant and one of her children can be very sickly. She is taking quite a bit of time off work due to this which is putting her job at risk. The father refuses to help and will only have them on his specific days. Does the father have respnsibility to take time off work or is it down to the mother? Any advice would be appreciated.

Does she only want him to have them when one is sickly? Doesn't seem fair he should then have to take time off work at other times when she decides. If the court order set out access arrangements then surely it has to be adhered to. She needs to decide which comes first her job or her kids.
she Is the main carer therefore it’s her responsibility, in an ideal world the child’s father would help out but there is not a legal requirement (is my understanding)

No they go to him every other weekend and every wednesday. She would like him to share responsibility when the children are sick. He refuses to take time off work to look after them when they are off school sick.
She they go to court over custody?
Did she want full custody?
She should have got it written into the agreement

Yes they have a court order. The court awarded her full custody and the father access.
As I understand it RH has it right.

Of course we dont know the circumstances of the Court order or any of the problems that may have occurred around it.
i would expect that if the sickness was on a wednesday, the dad should take time off. any other schoolday, the mum should take time off (or make other arrangements
I hate to sound harsh but if you want full custody then you have to take all aspects of it and that includes caring for the child when sick.

If this is no longer an option then she should go back to court and ask for an amendment to the order - if that is possible
