What, if I have any, are my options?

Over two years ago I split from my partner of 6 years. We had bought a house together only a year previous to our split after which I moved out and rented back home and he stayed at the house. For the last two years or more I ahve been trying, unsuccessfully, to take my name off of the mortgage as he wishes not to sell ( basically we borrowed more than the house is worth and he can't afford the difference). Everytime I apply to take my name off, I'm told he's gone back into arrears so it will go on hold until he's up to date again as my name can not be taken off iwth the account in arrears ( I haven't paid or had anything to do witn the house for over 2 years now). How long can this go on before I'm finally free of this mortgage and do I have any options as his arrears are obviously dragging my name through the credit agencies with his??

YOu will have to take him to court. As there are no children involved, the courts will make an application to sell the house unless your ex can prove he is in a position to buy you out.
