Hi, I was with my boyfriend for 5 years. We brought a house together 2.5 yrs ago. We split and remained living together until he beat me up and was put on conditional bail. He is now not paying anything towards the mortgage or outstanding bills and I can only contact him through a solicitor which he is not responding to. I am happy to take on the mortgage alone along with the arrears but he will not sign it over to me. I know a court of law can order for a house to be sold but can they order for one owner to sign their half over to the other? If so how do I go about arragining this? Thak you all so much

i am only giving you my opinion here, not legal advice. I dont see why he should lose his half of what he paid in for the last 2.5 years. I can see why he is not paying now after all he is not living there or using any amenities, so he shuldn't have to. Do you have a joint mortgage, or seperate mortgages on the property? if you already have a solicitor i would advise you ask her.
Normally, a court would calculate the equity and input for the 2.5 years he was contributing to the household and living in the home. Therefore, make him a reasonable offer based on this. If he refuses then there is very little you can do and the longer it goes on the larger his 50% of the equity gets.

Get a solicitor.
