they have been sending me letters every few months demanding that I pay a dept that is'nt mine.I've never answered any of their letters now they're saying if I dont get in contact they will send someone to my home. I don't owe them or anyone else any money and have no intention of paying a dept that's not mine. I've also received letters from another dept collection agency called Mackenzie Hall concerning the same dept
Write back to them and demand that they prove the debt is yours. You want evidence and signed application forms. Tell them that they have the wrong person and if they cannot prove the debt is yours and they continue to harrass you then you will report them to the OFT.
They are mean people, type in capquest on google and look at all the complaints. I stupidly started paying my supposed debt without asking for proof from CapQuest becuase I was that worried baliffs were going to come round. I am now going to ask for proof of my "debt" and if they can't provide it I am not paying any more. They are bullies and i think they try to scare people into paying money
I have just phoned the financial ombudsman. They have told me capquest are a legitimate company who are registered with the Financial Services Authority (FSA). Under the data protection act you can write to them and ask for any information they have on you which will outline the debt. (I have written to them today requesting this information - they have 40 days to reply.) They have the debt because another company has sold it on to them - try and find out who this is and ask them for details of the debt too.

They said to me that the Citizens Advice Bureau will be able to help as well. Try them to see what would happen if you don't pay. I do know from them that they cannot send anyone to your house without a court order so do not open the door to them. If they go to court they have to inform you. Phone the police if they will not go away as they have no right to be there without an order. They also cannot harass you so tell them you will report them if they keep on at you.

What CAJI says is correct, except that they can send someone to see you without a Court order. However, if they do the person who comes has no authority whatsoever and has no right to harass or bully you. They will not be a bailiff, although they might try to pretend that they are! Bailiffs can only come after a Court has granted a County Court Judgement. If anyone comes do not let them into the house.

I understand some debt collection businesses - including Capquest - sometimes buy debts where the debtor has disappeared. They then try to trace the debtor and if they find someone with the same name (or a sufficiently similar one) contact them alleging that they owe the money. So it is quite possible that this is not your debt at all.

Whatever you do, do not get involved in telephone contact with them - if they get your number and ring you, refuse to talk to them on the phone. If necessary, leave them to listen to loud music from your radio - placed just beside the phone you left off the hook!

Any letters should go by recorded delivery and keep a copy. As already said, demand proof of the debt.
