Not sure were to post this question. Wen we went to sign paperwork for house they informed us that we have a shared alley way leading to back of our house and next door. But the garden fence paths etc have laid been laid out to make it look like we had private alley way on the right of the house. A bit gutted. Feeling let down. We werent told this until after we.d payed for bits and bobs. Would u complain if it were you...thought the idea of a detached house was that its private??

I dont think there is much you can do about it now, especially as they told you before signing, did your solicitors not make you aware of this on the deeds, did you actually see the drawings/plans of the property.

it was only the persimmon salesman who got us to sign the paperwork. I did have a confused look on my face when signing it. After signing we took another peek at house then realized the garden etc didn't represent the plans. So we got the saleman to come and have a look and he agreed 100% that the garden...fence.... turf etc was made to look like our alley way was on the right. He said he would speak to the site manager and agreed it would probably be easier to keep it as it was. But had a phonecall today to say its all been changed to tally with plans, But we weren't aware of the layout untill after we had payed for survey,,,add ons and survey fee. Had we known this house had a shared alleyway then we may not of bought
You need to talk to your solicitor but it sounds like it may be too late now.

Maybe someone else will come along and advise you better.

Is there not a cooling off period? Although customisation rules are a little different to usual purchases I can't imagine they would start your customisation of the house imediately.

Did you sign contracts and pay the house deposit etc?
To add, if you get no joy from the area MD escalate to the main head office in York.

Havnt got that far yet. I believe the survey was done yesterday and we should be getting a mortgahe offer very soon.
There were a lot of problems with Persimmon in my area a few years ago. I know this is not helpful but why did you sign paperwork without consulting a solicitor? Write to the CEO.
You should have been informed. You may have a case against your solicitor if they didn't point it out.

I was informed of a public right of access to an alley (to others' back gardens) to the side of my place. I was informed before purchase (decided it wasn't a big issue and much better than the more common shared driveway most have in the area).
if you have no mortgage in place yet I can't understand how you were able to sign any paperwork...there must be a cooling off period...withdraw your offer formally now..

I don't believe that I took over two minutes to get and post that.
What about the customisation? That usually has different rules. Mind you as I said earlier if you catch them in time before they start the process you may be better off.

Is it the case that you have bought off plan and have paid a holding deposit?

I had this in 1985 thank god and learnt good !
when you are going around a house ask "what do I get"
the answer will often surprise

one said: oh you ask the lawyer that when you sign (!!) we only show around. That involved quite a large garden actually. the clerk showing us around didnt seem fazed at all that she didnt know what she was selling

another said - three flats - the bottom one is the dominant tenant and only you two others pay for the roof ( !) no access to the garden only the bottom flat ( !!) and no dogs ( !!! )
I said this is a deal breaker
and she said yes I know ....
When we were young and silly, before we bought our first house we did loads of recreational looking mainly at new builds...we found....houses with the interior doors removed to make the rooms look bigger, also you can fit more stuff in.....”fake” beds that were slightly smaller than a standard bed which either would not have fitted or would have blocked the built in wardrobe....showhouse gardens fenced and dressed to look like you got next door’s garden as well....It was amazing how much easier it is to notice these things when you have zero intention of buying......I am really sorry you are in this position....you might try putting your foot down with Persimmon as they misrepresented to you?
