Can A Council Legally Make You Have A Wheelie Bin If You Have No Room?

I wondered if there is a law to protect residents against a council forcing people to have a wheelie bin?

we live in a small front garden property, there is no room for a 4ft tall wheelie bin, do people have a right to refuse it if:

The bin is blocking the entrance to the property (fire risk)
The bin site is close to a property entrance or window (actually 2 ft above the window cill)

Appreciate any advice..

You put this in law. There is of course no law regarding this, and the fall back from the council is probably that they decline to collect from houses that don't comply. That doesn't mean you have no recourse, if the council behaviour is downright unreasonable. If you have exhausted the appeal process, the next stage above is talking to the local government...

i am really puzzled by your post. You state you have a front garden, yet you state the wheelie bin won't fit in. I am trying to envisage what it looks like but can't.
A wheelie bin isnt bigger than a person, and if a person can get into your garden why can't the bin?.
I also can't see why the bin would block your access - just put it away from the door , further along the garden
Bednobs - my neighbours have front gardens. They are slightly bigger than a recycling box.

lol thanks again for the quick replies, especially Dogsbody 2, yes thats the advice I have taken I just wondered if there had been a precedent set by any other case, I couldn't find one.

There is also a video done by the residents of Chiswick in previous roll out of bins..their gardens are much larger than ours though!



I think end of the day we have no voice and the council won't listen, I'll see what the complaint does and the ombudsman but I don't hold out much hope:( Look like wheeling the bloody bin through the house every 2 weeks might be our only option, or dispose of it ourselves.
If your garden is that small what do you do with your rubbish now?
Our garden is 12 ft by 5 ft but it has 3 wheelie bins and a recycle box,it all fits but only just.
Why not go as some other resisents did. They to had the bins forced upon them .. they wheeled all their bins round to their local councillors house and left them at his door.

I grew up in one similar and there was a small flower bed where Dad planted a rose bush.

My daughter has 4 wheelie bins and the fire service did a tour of the area and told people not to store them under the windows for safety reasons - she had to dig up the only remaining bit of greenery she had to accommodate them.

lol I think "ummm" answer is the best but in answer to bednobs, seriously our front is barley able to fit a person because we have a hedge, I can with fiddle get my bike behind it, but the wall has an electrical and gas meter box sticking out , so it impossible to get a wheelie bin down there, remember it has to have space for the wheels as well as the bin, believe me I tried!

Yes this is the road where protesters took their bins round the council leaders house! Trouble is he called the police and got the leader arrested 2 days later..:( rumours are circulating the took the petition and threw it away.
What do you do with your rubbish currently?
Like someone has already said on here, you can get smaller wheelie bins - maybe you could ask about them ?
if you have neighbors in a similar predicament why not ask the council for communal bins left at the end of the street say,I don't hold out much hope tho as councils are not noted for using imagination or straying from the rules.But there might be a rebel among them who considers the ratepayers
i quite like my wheelie bin under my bedroom window.......if there were a fire, it would certainly break my fall from a damn sight higher. bins are fine there unless some spud-for-brain sets fire to it!

Currently we have to dispose of the rubbish ourselves at the dump or a friends bin, the whole street looks awful, today was pickup day and bins all over the place. God knows what it would be like if it was a windy day. They used to be abel to do the street in a few mins now it takes them forever wheeling the dam things back & forth between cars & slotting into to the lifting machine.
As for having the bin under your bedroom window, how about someone standing on it to break in! Or the smell in the summer with the window open..
