"certificate of caution" can some one knock on your door and tell you to sign it and is it legal to do that

A man from D W P came to my house and said i had to sign this certificate of caution i declined to sign because i dident know what it was ..Is it within the law for him to keep knocking ?.[im trying to get legal advice before I do anythink ] Im feeling a bit intimadated because he knockes at half seven at night..

It is pretty obvious that they or someone has seen your ex coming to and from the house and thinks he is living with you. You need to explain the true situation and get your ex to explain it as well.
As you say he (the ex) is a self employed builder it is quite possible he is being investigated to see if his statements of income etc are true and that is how they have seen...

He can also stop your benefit and your housing benefit. Why don't you talk to the guy and see what he wants.
Did you ask him what the caution was for?
it means they have enough evidence to prosecute you, and signing a caution would stop legal proceedings for that matter.

so it's your choice.. caution or prosecution.
Speak to your local CAB before you sign anything
it's the lowest form of sanction the DWP can offer you. you will have had an Interview Under Caution (if you attended) relating to a potential criminal offence, and coming out at 7.30pm is probably considered a reasonable time to catch you in, if perhaps you are now working.
Most of the time it means they have very weak evidence and don't want to risk a court case. Looks good for there legal department

thank you suspect, the best advice i got all day, you are a very nice man ..I dont get benefits any more .I did for six months when i fell on hard times and iv never had houseing benefits ..yes thay did interview me but it was about a year ago and i thought it was sorted out when i left there office ...so why a year later???the caution i was told by the knocking man is because thay dont believe that my durty no good ,ugle, fat ,ex had ran off with the local bike..[he looks like shrek ]but im not bitter]
I prosecute benefit fraud cases, but feel free to take whatever advice you prefer!

so why a year later ??i dident do anythink wrong , if i sign the caution im saying i did somethink wrong and i did nothink
it can take a long time to get the overpayment calculated, but a year is a long time. can I ask how much the overpayment is?

also, they can only offer a caution if you've virtually admitted that you committed fraud, so did you admit it when you were interviewed?

if you sign the caution you'll be signing to say as much.

no i dident admit to anythink you cant say you did somethink if you dident do somethink?[if you get what i meen]i think my exs girl friend may of made a phone call to them after i trough a bucket of water over her because she knocked on my door..[why do people always knock on my door??]any way it doesent help me that my ex is a self employed builder and that his storage is the garage at my house and still is but i told them this at the time

thank you sara things are a bit clearer now im 47 and iv only just worked out how to send a normal email .it was very kind of you to offer .oh and your bum even says knock [iv only just noticed ]xxxxxxxxxxxx

yes the man said it was a over payment because my ex was still liveing there but he wasent he left the day i found out and hasent been back only to use the garage
