I have just received a letter telling me that I owe a parking charge. This was for parking in a car park using my Blue Badge. I have used before my Blue Badge in this car park before but am now threatened with a £100 fine by Civil Enforcement. How can I fight this? Does anyone know? Advice please.

There is no legal requirement to provide x amount of disabled parking spaces in a public car park under the Equality Act 2010. Government guidelines recommend that 6% of available parking spaces are designated as disabled bays and it is relatively easy to check using websites such as Parkopedia which tell you how many parking spaces each car park has. If it's a council one then pay it ASAP or it will escalate, usually there is a discount if you pay quickly. It will not go away and will get bigger and bigger and a bailiff will come and demand several hundreds of pounds. You can pay it now without prejudice and then seek to recover it if you think there is an avenue for that. If it's a private one then you can ignore, they usually send you threatening letters for a year or so, they rarely take you to court but they can.
I have rightly criticised for my advice, and I withdraw it with apologies.

Appeal sent. Now I just wait.
What are your grounds for the appeal?
Your daughter should let them know you were driving the car so they can cancel her notice and then issue a notice to you as the driver.

I'm not sure you can appeal since you've not been notified yet.

Daughter was driving me so I could go shopping.

She was driving and so we used her car but the Blue Badge is in my name.

I'm puzzled by the 18.24 post...a local pub has put tables, chairs etc over the disabled parking spaces and prevented cars parking there?
If this is indeed a council car park, why hasn't the council taken action?

I do apologise as I certainly did not make the situation clear.
1. I wanted to go shopping but was doubtful if what I wanted to get would fit in my smallish 2-seater mini.
2. Daughter offered to take me in her larger car. An offer I accepted.
3. I believed that as I wanted to shop I could use my Blue Badge when we parked.
4. As at the moment I have heart and lung problems (waiting to get them fixed but hospital very busy) which affect my speed of walking daughter came into shop with me in case I needed help in any way.
5. Letter was delivered to her but I consider it is my problem as I was the one who wanted to shop.
I hope this makes it all a bit clearer. I can only say I am sorry for any confusion but I was tired at the time and realise that although the situation was clear in my mind I did not explain adequately.

Don't worry about the confusion, LJ. Have you looked at that Parkopedia link I posted? If the car park you used is on that map click on it and there should be a phone number, phone them up and ask if blue badge holders have to pay to park.

Thanks Barry. I have checked and they want a written reply.
I also found a link to the owners and evidently they have had a lot of complaints about the way the site has been monitored and they are in the process of changing the system. So I've got my fingers crossed as £100 is a lot out of my pension. Not moaning just stating a fact.

When you checked did you find out if you should have paid? Hope it is cancelled, last thing you want at this time of year

Thanks for your good wishes Barry.

I have now heard from the owners of the car and they reiterate that I should have paid for parking however in this instance they have waived the fine but reminded me that I must make sure I pay in future. This of course I will ensure I do.
