IMO your employer would be a fool to do this if it's allowed which I think it is, firstly because he has acted within the rules by giving the right amount of notice
Because it then means, giving his staff this day as a day off, he will then have to give you all the holiday he could make you take on that day at another time

There is no such law- provided your total holidays (including statutory holidays) equals or exceeds the statutory minimum figure the employer can decide on when holidays should be taken (subject to the contract of employment that is in place)
I work for one of our major retailers, and when Christmas Day falls on my normal day off - I lose out. Aggravates me no end when it happens, as it did last year. In fact, as my normal days off are Sunday and Monday I missed out on Christmas Day, Boxing Day and New Years Day!!!

thankyou factor30, however you miss my real issue. its not a holiday im concerned about its my actual rota day off. in my contract im thursdays off, my boss thinks hes changing it to xmas day, however xmas day is one of my chosen 28 days statutory days holiday. thanks.

lyndab, totally get where youre coming from also. if my rota day off falls on a public holiday then i just lose it, shame but fact, proving my point, should your manager be moving your day off just to suit his staffing in xmas week, not for any other reason.

Hi ibizaboy- I'm not sure what is meant by "however xmas day is one of my chosen 28 days statutory days holiday".
Ibiza, you need to speak to someone. Just because your day off does not fall on a bank holiday, you are still entitled to 4/5 of the bank holidays (which is eight days a year). If you day off fell on a Monday this is not necessarily an advantage as you have to make up the extra time. The important thing is whether you are being asked to include this in with your statutory days thus bringing your annual leave below the allowance. do you have a Citizen's Advice Centre near you? Give them a ring and see if you can make an appointment with someone who knows about employment law.
I'm not sure, Anngel that that is the issue - I think ibizaboy is not losing a day's holiday- he is just having to have his holiday on a different day from when he hoped to have it.
This was standard practice in my old job. I would have a wednesday off every week and christmas week the day would be changed to christmas day. Can't imagine nayone is breaking any rules. It's just annoying.
