I bought a sofa and chair back in March/April this year.
the sofa has developed two faults one being the sofa seat
cushion is coming away from the seam causing
a small tear and the other where some studs have come away
from the base of the sofa.

Unless you, your family and friends are horrendously obese I can’t see how they can cite ‘heavy use’ as an excuse for the company’s shoddy workmanship. You could take them to the Small Claims Court. Ask CAB for help or look at Martin Lewis’s website.

hc, we had a devil of a job, including taking off the front door, to get the sofa in. I don't want a new one just the repairs put right.
Just add the cost of removing/replacing door into your claim. That'll focus there minds even more ☺☺☺

i have e mailed them to express my dissatisfaction with their response i will wait and see what they have to say.
All the so called assessors I've come across as regards to a sofa problem, in the houses I've been in say the same thing. Wear and tear.

they made a promise weeks and weeks ago to send me another seat cushion, they reneged on their promise

i am the sole user by the way, no family here in London.
It's the assessors job to minimise any possible claim - they are employed by the company and are not independent.

It cannot possibly be wear and tear after such a short time especially as they give a 15 year guarantee. Even the cheapest of sofas should not show signs of wear and tear within a year.
SlackAlice. Its up to the customer to make sure the sofa will fit through the door, or make other arrangements. Not the retailer.
Trading Standards is normally a section of your Local Authority. So you should be able to find out from where your Local Council is now operating.

Did you receive a copy of the report from the 'Independent Assessor' who, in effect, was acting on behalf of the firm from whom you purchased the furniture.

I think it's an attempt by the firm to dodge out of a legal liability. Trading Standards should be able to advise you on the issue concerned and might even pursue matters on your behalf, without it costing you anything.

You are right, teacake, and emmie bore the cost/inconvenience when her sofa was delivered.
If it has to be removed because of a manufacturing defect then the company will have to bear the cost.
Trading Standards investigate and prosecute firms acting illegally but don't get involved in an individual's claim, they simply refer them to CAB or the Citizens Advice Consumer Service.

I have never lost a case, SlackAlice. I have helped many people with their claim and very rarely does it get to court and when it does we always win. Of course I make sure that the claim is sound to start with, can't stand blaggers on the take.

I'm just really disappointed they have responded the way they have. Will contact local authority Trading Standards.
if not Martin Lewis money expert.
Shoddy goods seems to be the thing now, make it cheap, take your money and run.
